During the first half of the meeting topics raised and discussed at length centred around the Town Centre Masterplan and how progressing development within the Town Centre would be beneficial to the Bassendean Hawaiian Shopping Centre.
During the latter part of the meeting Mr Greenwood expressed a desire to progress potential purchase by Hawaiian of Road Reserves under Management Orders to the Town of Bassendean i.e. portions of Extension Road and West Road adjacent to Bassendean Shopping Centre. This is a matter that has previously been brought before a full Council twice in 2021 and deferred on both occasions. Rationale promoted by Mr Greenwood centred around a desire to reduce risk in relation to loss of parking bays located upon said Road Reserves, and to amalgamate this land into the Hawaiian site.
Response: A meeting invitation from the office of the General Manager-Shopping Centres, Hawaiian Group was forwarded to me on the 10th of March 2022. The invitation was subsequently extended to also include Mr Luke Gibson, Director Community Planning, Development and Place for the Town of Bassendean. That meeting took place at Dome Café on the morning of 21st of March.
The Town’s Director of Community Planning, Mr Gibson, articulated that the Metro Central Joint Development Assessment Panel (JDAP) had approved the development application of the Hawaiian Shopping Centre in August 2012 that included 107 parking bays located within the adjacent Road reserve, and as such it may be that that aspect of the development could not be extinguished unless there is potentially another new Development Application lodged by Hawaiian for the Shopping Centre at some time in the future. In response to Mr Greenwood's proposal, I suggested that any potential future development plans of the Hawaiian site would undoubtedly be subject to all the checks and balances associated with a major development proposal, and again likely to be considered by JDAP. I indicated that large scale DA’s are normally accompanied by multiple detailed reports such as transport and access studies of the site and surrounding localities, plus the Town Centre Masterplan identifies potential development of Community facilities on the western side of Bassendean Oval, and as such the best planning outcomes may be more likely via a future comprehensive, informative DA process rather than a piecemeal approach as currently being proposed.
In addition to the above, I’m given to understand from Mr Greenwood that initial dialogue with Town officers in early 2020 centred around formalising a peppercorn Licence Agreement between the parties for existing 107 parking spaces. I also understand that, based on feedback from the Town’s solicitors, negotiations re a peppercorn licence or lease agreement evolved into discussions of the potential to purchase the subject land from the State Government if the Town of Bassendean makes a request to the Minister of Lands for the permanent closure of portions of Extension Road reserves adjoining the Hawaiian Shopping Centre site at Bassendean.
As an individual councillor I indicated that consideration and decisions on a matter such as this can only be made by a full Council.

Response: The Town’s local planning policy (LPP 4) relating to development in the floodway was developed based upon the advice provided by the former Department of Water and the Swan River Trust. Therefore, these agencies would also need to support subdivision in this location as it is not the Town that is the determining authority.
Although the motion (OCM – 24/08/17) was carried, the local planning policy has not yet been through the formal process of being amended, endorsed by Council, advertised to the community and finally being adopted by Council. The Policy is a properly adopted policy under the Local Planning Scheme No. 10, and Council and officers are required to give due regard to the policy whilst making decisions until a new policy is adopted.
Given that the EMRC flood study is due to be released in the next few months staff are awaiting the results of this study to be able to provide Council with an up to date report to inform the policy revision. It would be premature to present a report to Council before this information is released.
It was suggested that instead of the Town contacting WAPC to seek the opportunity to provide a revised report on the current subdivision applications that Mr Bethune or the affected property owners contact WAPC and request that updated advice be sought.

I responded that 10am didn’t suit me but that I could make it by 11am and suggested the Council offices would be a more suitable venue. I had no reason to question if it was a sanctioned meeting as we had met with an Hawaiian rep (male) in the Council chamber some time before on a parking matter, with staff in attendance, and I assumed this was an onsite continuation of this meeting.
I attended the meeting with Councillors Gangell, McLennan, Pule and Lewis (Cr Brown was ill and no ToB staff were in attendance) and Alison and the formerly mentioned male attended from Hawaiian. They offered a coffee but I declined. Basically it was the same parking matter but this time plans were presented that showed what they proposed for the area in the upper carpark they wished to make a public space.
Also presented were plans to convert part of Whitfield St road reserve to right angle parking to make up for the potential loss of the upper car park bays. I asked if they had discussed these plans with planning staff and they stated they had. My comment in response to ‘what did we think?’ was that we would consider this when the DA was presented and with officer comment and recommendations.
Councillors Pule and Lewis then went with the Hawaiian rep/s to view the Whitfield St proposal and myself, Gangell and McLennan left. |

The meeting was arranged for 11am as preferred by Councillors.
The topic was to discuss parking and traffic management at the Bassendean Village Shopping centre.
I assumed that our officers would attend, however,there were no Officers at this meeting.
In attendance, from Hawaiian, there were Alison, the Regional Manager and the Centre Manager.
I attended, together with Crs Gangell, Mclennan, Bridges and Lewis. Cr Brownreported ill and there were no officers from the Town of Bassendean at this meeting.
Coffee was offered and I ordered and paid for my own.
Discussion took place on a similar manner to the previous presentation by Hawaiian given at Council and with officers in attendance at that time. The discussion was about addressing establishing a public open space at the Dome end of the car park, re arranging the car park and right angle parking at Whitefield street. Also entry and exit positions from West road and Whitefield street .
My response was to ask if these proposals, as presented, had been discussed with Town of BassendeanPlanning Officer and they responded that they had been discussed with Planning Officers. I inform Hawaiian that Councillors would need to again have further discussions with our Planning Officers and the CEO.
I responded that Councillors and myself would discuss these matters with our Officers and that we would consider them when presented with Officer recommendations in our formal meetings.
Crs Gangell, Lewis and myself inspected the Whitefield street area concerned and the car park with the Hawaiian Regional Manager. Cr Lewis and myself also discussed the clarity of no smoking signs at the Bassendean Village Shopping Centre with the Centre Manager and suggested better clarity signs.
That was the end of this meeting.

I responded that I should be able to attend but may have my daughter with me. I was aware that fairly recently, other councillors had met with Hawaiian representatives at the council offices with staff in attendance to discuss a parking matter. I was not in attendance at this previous meeting but expected that this particular meeting was an onsite continuation of this meeting.
I attended the meeting with Councillors Gangell, Bridges, Pule and Lewis (Cr Brown was ill and no ToB staff were in attendance) and three Hawaiian representatives. A coffee was offered but I declined.
The representatives presented
a) Plans to convert part of the upper carpark into a public space with trees, seating & a play space with potential for hosting public events such as outdoor movies. This plan would necessitate the loss of some of the current car bays in the upper level.
b) Plans to convert part of Whitfield St road reserve to right angle parking to compensate for the potential loss of the upper car park bays.
Cr Bridges asked if the plans had been discussed ToB planning staff and they stated that they had. The representatives asked the Councillors what our thoughts were on the proposal and were told that they needed to formally submit a development application and that council would consider the proposal when it was presented with officer comment and recommendations.
Following the meeting Councillors Pule and Lewis then went with the Hawaiian representatives to view the Whitfield Street parking proposal and myself, Gangell and Bridges left. |

Response: As Mayor I received a request on 8 July 2016 for Hawaiian representatives to meet informally with Councillors to discuss a proposed development application they were looking at submitting which would make some alterations to the top level car park and Wilson Street parking. I emailed Councillors to arrange a suitable meeting.
The topic was to discuss parking and traffic management at the Bassendean Village Shopping centre.
In attendance, from Hawaiian, there was Alison Reid, Jamie Nancarrow and Julie Purser from Hawaiian Pty Ltd.
I attended, together with Deputy Mayor Cr Lewis, Cr Pule, Cr Bridges and Cr McLennan.
