Proposed Use Not Listed (Short Stay Accommodation) – 13A Gallagher Street, Eden Hill (Closed)


The previous application for a use not listed (short stay accommodation) at this address was refused by the Town’s Council on 22 February 2022. The applicant has since appealed the decision to the State Administrative Tribunal. The State Administrative Tribunal aims to review the decision and attempts to achieve a resolution where there is a dispute. In this case, the applicant has provided amended information and therefore the SAT has invited the Town under Section 31 of the State Administrative Tribunal Act 2004 to reconsider its decision.

 

As part of this process, the applicant has provided the Town with an amended management plan that aims to further address concerns about possible amenity impacts on the surrounding properties. As part of the reconsideration of the process and assessment, the Town is required re-advertise the proposal, including the amended management plan. The application will then be re-considered by Council.

 

The proposed use is for a use not listed (short stay accommodation) and is detailed below:

 

  • Accommodating a maximum of four guests;
  • Minimum stay length is three nights;
  • Utilising one room in the home for massages and beauty treatments for guests;
  • Parking is contained within the enclosed garage and driveway (maximum of two cars for guests). No parking on the verge or street is to be permitted;
  • Guests will be instructed to keep noise levels low between 7:00pm and 7:00am. Noise monitoring devices have been installed;
  • The listing of the accommodation will state that no parties are permitted at the property; and
  • Responsibility of compliance rests solely on the landowner to address any complaints.
